Is physically disciplining children permitted in Islām ?

Question

What are the Sharīʿah limits regarding parents, guardians, and teachers physically disciplining children? In particular, from what age is hitting permissible, what are the limits regarding when, where, and how hard a child may be hit, and does parental permission make it permissible for a teacher to do so?

Answer

Physical discipline is not permissible before the age of tamyīz according to some jurists. After tamyīz, a child may be appropriately disciplined within the limits prescribed by the Sharīʿah. Such discipline must be proportionate, non-harmful, and genuinely intended for the child’s reformation.

Consider the following:

1. The Sharīʿah emphasises the role that parents and guardians play in nurturing and raising children upon good conduct and noble character.

2. To achieve this, the Sacred Law has prescribed various measures through which children should be nurtured with love, care, and compassion. The young companion Anas ibn Mālik, for example, relates that he served the Messenger of Allah ﷺ for ten years, and throughout this period, the Prophet ﷺ neither struck him nor scolded him. Rather, he ﷺ dealt with children with kindness, love, and compassion.

3. When education, gentle reminders and stern warnings fail to cultivate responsible behavior in a child, Islamic law permits physical discipline as a last resort, strictly within specified limits, to help establish necessary habits.These conditions include:

a) According to some jurists, the child should have reached the age of tamyīz. Tamyīz is not determined by age alone; rather, it is established when the child has sufficient understanding and is able to perform basic matters independently, such as eating, drinking, and cleaning himself or herself after relieving themselves. This commonly occurs around the age of seven.

b) The hitting must be for the child’s benefit and not out of anger, frustration, or personal interest.

c) One may only resort to hitting when a lighter form of discipline has proven ineffective.

d) Similarly, one may only resort to hitting if it is known to be effective; otherwise, it is not permissible.

e) One may not hit the child on the face or on any dangerous or vulnerable part of the body.

f) The hitting must be mild and not intense, and must not cause injury or harm.

g) Once a child reaches puberty and attains rushd (sound judgment and competence in managing religious and financial affairs), it is no longer permissible for the parent to physically discipline the child.

4. According to the relied-upon position in the Shāfiʿī school, a teacher requires the permission of the child’s guardian to physically discipline the child. The teacher’s authority is limited to matters related to the learner’s education and conduct and does not extend to private disputes or personal matters. All of the conditions mentioned above must also be observed in this regard.

5. Nonetheless, one should be mindful that physical discipline, even when considered moderate or reasonable, is unlawful in South Africa. In 2019, the Constitutional Court declared the common-law defence of “reasonable and moderate parental chastisement” constitutionally invalid.

قال الجمل في حاشيته على شرح المنهج:

(قوله: بنحو حبس وضرب) ولا يجوز بأخذ المال. قال في الخادم: واعلم أنه إنما يجوز الضرب بشروط: أحدها: أن لا يكون بشيء يجرح. الثاني: أن لا يكسر العظم. الثالث: أن ينفع الضرب ويفيد، وإلا لم يجز. الرابع: أن لا يحصل المقصود بالتهديد والتخويف. الخامس: أن لا يكون في الوجه. السادس: أن لا يكون في مقتل. السابع: أن يكون لمصلحة الصبي، فإن أدبه الولي لمصلحته أو المعلم لمصلحته دون مصلحة الصغير.. لم يجز؛ لأنه يحرم استعماله في مصالحه التي تفوت بها مصالح الصبي. الثامن: أن يكون بعد التمييز اهـ وقوله: الرابع. . . إلخ عبارة العباب كالروض في هذا ولا يجاوز رتبة ودونها كاف قال في الروض بل يعزر بالأخف فالأخف قال في شرحه كما في دفع الصائل اهـ سم.

(وعزر أب) وإن علا وألحق به الرافعي الام وإن علت (ومأذونه) أي من أذن له في التعزير كالمعلم (صغيرا) وسفيها بارتكابهما ما لا يليق زجرا لهما عن سئ الاخلاق وللمعلم تعزير المتعلم منه (و) عزر (زوج) زوجته (لحقه) كنشوزها لا لحق الله تعالى.

وللمعلم تأديب المتعلم منه لكن بإذن ولي المحجور، وللزوج تعزير زوجته لحق نفسه كنشوز م ر: وقوله: وللمعلم ظاهره ولو كافرا وهو ظاهر حيث تعين للتعليم، أو كان أصلح من غيره في التعليم، وعبارة ق ل ومعلم لمتعلم منه ولو غير صبي وسواء أذن له الولي، أو لا إذ له التأديب ولو بالضرب بغير إذن الولي على المعتمد.

قال ع ش ومن ذلك الشيخ مع الطلبة فله تأديب من حصل منه ما يقتضي تأديبه فيما يتعلق بالتعلم وليس منه ما جرت به العادة من أن المتعلم إذا توجه عليه حق لغيره يأتي صاحب الحق للشيخ ويطلب منه أن يخلصه من المتعلم منه فإذا طلبه الشيخ منه ولم يوفه فليس له ضربه ولا تأديبه على الامتناع من توفية الحق فلو عزره الشيخ بالضرب وغيره حرم عليه ذلك، لأنه لا ولاية له عليهم.
