Does a written divorce constitute a divorce ?

Question

I would like to seek guidance regarding a written ṭalāq issued to me by my husband while he was in a state of extreme anger and intoxication. He says that he did not intend the ṭalāq.

Answer

The written divorce issued by your husband will only be valid if he intended, by writing it, to effect a divorce. If he did not have such an intention, the divorce is not valid and you remain married. Please bear in mind that if your husband is untruthful in claiming that he did not intend the divorce, your marriage would outwardly be considered valid based on his statement. However, in reality, before Allah, the divorce would have taken effect, and he would bear the sin of continuing to live with you in a ḥarām relationship.

Consider the following:

1. Addressing one’s spouse with the intention of causing them harm is impermissible and a grave sin.

2. Furthermore, an explicit verbal divorce of an intoxicated individual takes effect, regardless of whether he intended the divorce or not.

3. A written divorce, on the other hand, is only valid if the person writing it intends, by writing it, to effect an actual divorce.

4. Your spouse’s claim that he did not intend the divorce at the time of writing it would mean that no divorce has taken place and that your marriage remains intact.

5. If, however, he is untruthful and had in fact intended the divorce, the divorce would have taken effect. You may nonetheless continue to remain in the marriage based on his claim. Your husband, on the other hand, if untruthful, will be accountable before Allah for his dishonesty and for continuing to live with you despite the divorce having taken effect.

6. Lastly, a marriage characterised by reciprocal harm, emotional abuse, and substance abuse is unlikely to succeed. We therefore strongly advise you to urgently seek marital counselling in an effort to address and resolve your marital disputes.

قال حج في الطلاق:

(إلا السكران) ، وهو من زال عقله بمسكر تعديا، وهو المراد به حيث أطلق وسيذكر أن مثله كل من زال عقله بما أثم به من نحو شراب أو دواء فإنه يقع طلاقه مع عدم تكليفه على الأصح أي مخاطبته حال السكر لعدم فهمه الذي هو شرط التكليف ونفوذ تصرفاته له وعليه الدال عليه إجماع الصحابة - رضي الله عنهم - على مؤاخذته بالقذف من باب خطاب الوضع، وهو ربط الأحكام بالأسباب تغليظا عليه؛ لتعديه، وألحق ما له بما عليه طرد اللباب وبه يندفع ما لبعضهم هنا من إيراد النائم والمجنون على أن خطاب الوضع قد لا يعمهما ككون القتل سببا للقصاص، والنهي في {لا تقربوا الصلاة وأنتم سكارى} [النساء: ٤٣] لمن في أوائل النشأة لبقاء عقله فليس من محل الخلاف بخلاف من زال عقله سواء أصار زقا مطروحا أم لا، ومن أطلق عليه التكليف أراد أنه بعد صحوه مكلف بقضاء ما فاته أو أنه يجري عليه أحكام المكلفين، وإلا لزم صحة نحو صلاته وصومه، ويعلم مما مر أوائل الصلاة أنه لو اتصل جنون لم يتولد عن السكر به وقع عليه المدة التي ينتهي إليها السكر غالبا.

قال حج في كتاب الطلاق:

وقد يؤخذ من ذلك ما بحثه ابن الرفعة أن السكران لا ينفذ طلاقه بها لتوقفه على النية، وهي مستحيلة منه فمحل نفوذ تصرفه السابق إنما هو بالصرائح فقط، ولك أن تقول شرط الصريح أيضا قصد لفظه مطلقا أو لمعناه كما تقرر، والسكران يستحيل عليه قصد ذلك أيضا فكما أوقعوه به ولم ينظروا لذلك فكذا هي وكونها يشترط فيها قصدان وفيه قصد واحد لا يؤثر؛ لأن الملاحظ أن التغليظ عليه اقتضى الوقوع عليه بالصريح من غير قصد، وهذا بعينه موجود فيها فاتجه إطلاقهم لا ما بحثه، وإن أقروه إلا أن يجاب بأن الصريح موقع ظاهرا بمجرد لفظه من غير استفصال ولا تحقق قصد بخلاف الكناية لا بد فيها من تحقق القصد فافترقا انتهى

قوله: فكذا هي) أي الكناية فيقع بها من غير قصد اللفظ لمعناه ولكن لا بد من النية بأن يخبر عن نفسه أنه نوى سواء أخبر في حال السكر أو بعده. اهـ. ع ش عبارة الرشيدي ومعلوم أن الصورة أنه أخبر بأنه نوى إما في حال سكره أو بعده كما هو شأن الحكم بالوقوع بالكنايات وحينئذ فإنما أوقعنا عليه الطلاق بإقراره. اهـ.

قال الشرواني :

وقد يؤخذ من ذلك) أي قول المتن مع النية ما بحثه إلخ عبارة النهاية وما بحثه ابن الرفعة، وأقره جمع من عدم نفوذ طلاق السكران بالكناية لتوقفها إلخ مردود، كما اقتضاه إطلاقهم بأن الصريح يعتبر فيه قصد لفظه لمعناه إلخ، والقلب إلى ما قاله ابن الرفعة أميل. اهـ سيد عمر. (قوله: لتوقفه) أي الطلاق بالكناية (قوله: السابق) أي في شرح إلا السكران (قوله: ولك أن تقول إلخ) ، وأيضا فهو مؤاخذ بإقراره فإذا أقر أنه نوى آخذناه، وأوقعنا عليه
