Question
A husband passes away while his wife is observing the ʿiddah following ṭalāq. Does she still inherit from her deceased husband?
Answer
In the event of the death of one of the spouses :
1. The spouses will inherit from one another if the wife is observing the ʿiddah of a revocable divorce.
2. A revocable divorce refers to a divorce in which the husband has the right to take his wife back during her ʿiddah. This applies when the husband has issued one or two divorces only.
3. Neither spouse will inherit from the other if the wife is observing the ʿiddah following an irrevocable divorce or separation.
4. An irrevocable divorce or separation refers to a separation in which the husband does not have the right to take his wife back during her ʿiddah. This occurs when the husband issues three divorces, through khulʿ, where the wife gives compensation to the husband in exchange for the divorce, or through faskh, where a Qāḍī annuls the marriage.

(ويقع في مرض موته) ولو ثالثا إجماعا إلا ما شذ به الشعبي (ويتوارثان) أي من طلق مريضا والمطلقة (في عدة) طالق (رجعي) إجماعا (لا بائن) لانقطاع الزوجية (وفي القديم) ونص عليه في الجديد أيضا (ترثه) بشروط ليس هذا محل ذكرها وبه قال الأئمة الثالثة.

قول المتن (ترثه)إنما عبر به دون يتوارثان تنبيها على أنها لو ماتت لا يرثها، وهو كذلك. اهـ. مغني(قوله: بشروط إلخ)أحدها كون الزوجة وارثة فلو أسلمت بعد الطلاق فلا. ثانيها عدم اختيارها فلو اختلعت أو سألت فلا. ثالثها كون البينونة في مرض مخوف ونحوه ومات بسببه فإن برئ منه لا. رابعها كونها بالطلاق لا بلعان وفسخ. خامسها كونه منشأ ليخرج ما إذا أقر به. سادسها كونه منجزا. اهـ. مغني
