Are raffles permissible ?

Question

I recently came across a post advertising a raffle to raise funds for ʿUmrah. Participants purchase a ticket for the opportunity to win a particular item. Are raffles permissible?

Answer

It is impermissible to participate in a raffle due to the uncertainty surrounding whether one will receive the item in exchange for one’s contribution. Likewise, promoting or assisting in any of its activities is impermissible, as this constitutes assisting in something ḥarām.

Consider the following:

1. When participating in a raffle, one contributes money in exchange for an opportunity to win a particular item. The uncertainty as to whether one will attain the item in return for one’s contribution is a classical example of gharar (excessive uncertainty), which the Messenger of Allah ﷺ prohibited.

2. The fact that the raffle is intended to raise funds to send someone for ʿUmrah has no bearing on the above ruling. Regardless of how noble the objective may be, adopting ḥarām means to achieve it remains ḥarām.

3. Performing ʿUmrah is a noble act. However, it is not obligatory upon a person who does not have the financial means to undertake it. Seeking donations to fund one’s ʿUmrah journey is makrūh and discouraged. Whoever sincerely desires to perform ʿUmrah should turn to Allah in duʿāʾ, asking Him to grant them the opportunity, while making a concerted effort to earn and save the necessary funds. Our seniors would often save for many years to visit Makkah and Madinah, foregoing many luxuries along the way out of their deep longing to visit the sacred lands.

4. When there is a need for fundraising, we advise our community to abstain from competition-based fundraising and to utilise permissible means of raising funds, such as food stalls or cake sales, where actual items are sold.

السبق هو المال المخرج، ثم يفرض فيه ثلاث صور: إحداها - أن يخرج الإمام من مال المصالح ما يراه، ويقول للمتسابقين وللمتناضلين: من سبق منكما أو من فاز بالنضال، فله هذا المال، فهذا جائز على هذا الوجه، لا خلاف فيه، ولا حاجة إلى فرض محلل؛ فإن جملة المتسابقين والمتناضلين على صورة المحلل، فإن المحلل من يستحق لو فاز، ولا يستحق عليه لو تخلف، وجملتهم بهذه المثابة.

ولو أخرج المال واحد من عرض (١) الناس، وقال: من سبق منكم، أو فاز، فهذا المال له، فذلك جائز وفاقا، [كما يجوز] (٢) من الإمام، وهذان الوجهان لا خلاف فيهما على المذهب.

(يَقُولُ إنْ سَبَقْتنِي فَلَكَ عَلَيَّ كَذَا أَوْ سَبَقْتُك فَلَا شَيْءَ) لِي (عَلَيْك) إذْ لَا قِمَارَ

(فَإِنْ شَرَطَ أَنَّ مَنْ سَبَقَ مِنْهُمَا فَلَهُ عَلَى الْآخَرِ كَذَا لَمْ يَصِحَّ) لِتَرَدُّدِ كُلٍّ بَيْنَ أَنْ يَغْنَمَ أَوْ يَغْرَمَ وَهُوَ الْقِمَارُ الْمُحَرَّمُ

(الْخَامِسُ الْعِلْمُ بِهِ) أَيْ الْمَعْقُودِ عَلَيْهِ عَيْنًا فِي الْمُعَيَّنِ، وَقَدْرًا وَصِفَةً فِيمَا فِي الذِّمَّةِ كَمَا يُعْلَمُ مِنْ كَلَامِهِ الْآتِي لِلنَّهْيِ عَنْ بَيْعِ الْغَرَرِ، وَهُوَ مَا احْتَمَلَ أَمْرَيْنِ أَغْلَبُهُمَا أَخْوَفُهُمَا

فإن لم يجد زادا واحتاج أن يسأل الناس كره له اعتمادا على السؤال إن لم يكن له كسب وإلا منع بناء على تحريم المسألة للمكتسب كما بحثه الأذرعي.

(الإقناع)

قوله: (بناء على تحريم المسألة للمكتسب) أي لمن يقدر على الكسب ولم يكتسب بالفعل كما بحثه الأذرعي، وهو الراجح ق ل. وذكر بعضهم أنه ضعيف، والمعتمد أنها لا تحرم.

ويحرم السؤال على الغني بمال أو حرفة) تليق به ولم تشق عليه مشقة لا تحتمل عادة، ويكفيه وممونه دخلها.

فإن اختل شرط من ذلك .. جاز له السؤال، وله أن يسأل ما يحتاج إليه بعد يوم وليلة إلى وقت يعلم فيه تيسر ما يكفيه بسؤال أو غيره، وهذا في غير سؤال ما اعتيد سؤاله بين الأصدقاء كقلم وسواك، وإلا .. فلا حرمة مطلقا في سؤاله.
